Agreement between the Customer and DiscoverLuxury.com

DiscoverLuxury.com (the “Website”) exists specifically to assist customers in locating luxury hotels, ascertaining availability and room-rates and making reservations with travel suppliers. The terms "our", "we", "us", and "DiscoverLuxury.com" refer to Discover Luxury LLC a Connecticut USA based LLC.. The term "you" refers to a customer visiting the Website and/or making a reservation via the Website, or with a telephone sales agent.

By accessing or using this Website in any manner, you agree to be bound by the Agreement terms, conditions, and notices set forth below (the "Agreement”). We encourage you to please read the Agreement carefully. Should you not accept these terms and conditions in their entirety, you should not this Website. At our sole discretion and without prior notice we reserve the right to change or otherwise modify the Agreement. Your continued access or use of the Website signifies your acceptance of the modified or updated or Agreement.

Use of the Discover Luxury Website

As a condition of use of this Website you hereby warrant that:

1. You will use this Website in accordance with this Agreement.
2. You are no less than 18 years of age,
3. You possess the legal authority to create a binding legal obligation,
4. You will use this Website for the sole purpose of making reservations for yourself and/or  other persons for whom you are legally authorized to act,
5. All information supplied by you on this Website is true, accurate, current and complete.
6. We retain the right at any time and at our sole discretion to deny access to anyone to this Website and the services offered.

Prohibited Activities

The content on this Website, including, but not limited to, price and availability of hotel stays, as well as the infrastructure used to provide such content and information, is proprietary to us or our suppliers and providers. Other than making copies of your travel itinerary for hotels booked through this Website, you agree not to modify, copy, distribute, display, publish, license, create derivative works from, transfer, sell or re-sell any information, software, products, or services obtained via this Website. Additionally, you agree not to:

1. use this Website or its contents for any commercial purpose;
2. make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;
3. violate the restrictions in any robot exclusion headers on this Website or bypass or circumvent other measures employed to prevent or limit access to this Website;
4. take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
5. "frame", "mirror" or otherwise incorporate any part of this Website into any other website without our prior written authorization.

Supplier Rules and Restrictions

Separate terms and conditions will apply to your reservation and purchase of the travel services that you select. Please read these separate terms and conditions carefully. You agree to abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier's rules and restrictions regarding availability and use of fares, products, or services.

You acknowledge that some third-party providers offering certain services may require you to sign their liability waiver prior to participating in the service they offer. You understand that any violation of any such supplier's rules and restrictions may result in the cancellation of your reservation(s), in your being denied access to the applicable travel product, and the forfeit of any monies paid for such reservation(s), and/or in our debiting your account for any costs we incur as a result of such violation.

Hotel Reviews and Other Submissions

We encourage you to communicate with us. Please be aware that by submitting content to this Website by e-mail, postings on this Website or otherwise, including any hotel reviews, photographs, comments, suggestions or the like contained in any such submissions you (a) grant DiscoverLuxury.com and its affiliates the  nonexclusive, royalty-free, perpetual, transferable, and irrevocable right to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such Submissions throughout the world in any media; and (b) grant DiscoverLuxury.com its affiliates and sub-licensees the right to use the name that you submit in connection with such Submission. You further acknowledge that DiscoverLuxury.com may at our discretion choose to provide attribution of your comments or reviews. You further grant DiscoverLuxury.com the right to pursue at law any person or entity that violates your or DiscoverLuxury.com’s rights in the Submissions by a breach of this Agreement. We take no responsibility and assume no liability for any Submissions posted or submitted by you. Should you not agree to these conditions, we ask that you do not provide us with any Submissions..

You are fully responsible for the content of your Submissions, (including, but not limited to, reviews posted to this Website). You are prohibited from posting or transmitting to or from this Website: (i) any unlawful, threatening, libelous, defamatory, obscene, pornographic, or other material or content that would violate rights of publicity and/or privacy or that would violate any law; (ii) any commercial material or content (including, but not limited to, solicitation of funds, advertising, or marketing of any good or services); and (iii) any material or content that infringes, misappropriates or violates any copyright, trademark, patent right or other proprietary right of any third party. You shall be solely liable for any damages resulting from any violation of the foregoing restrictions, or any other harm resulting from your posting of content to this Website. You acknowledge that DiscoverLuxury.com has the right to use, publish or remove any content you submit without notice to you. If you believe in good faith that materials hosted by us infringe your copyright, you may notify us in writing notice clearly stating all relevant details of the copyrighted work you allege to have been infringed.

Prepaid Hotel Reservations

You acknowledge that DiscoverLuxury.com or its agents negotiates certain room rates with hotel and be aware that you may be liable for damages if found to be making a false claim suppliers to facilitate reservations on your behalf. The room rate displayed on the Website is a combination of the negotiated room rate for rooms reserved on your behalf by DiscoverLuxury.com. You authorize DiscoverLuxury.com to make reservations on your behalf for the total reservation price, which includes the room rate displayed on the Website, plus tax recovery charges, and any applicable service fees. You agree that your credit card will be charged by DiscoverLuxury.com for the total reservation price and upon submitting your reservation request you authorize DiscoverLuxury.com to facilitate hotel reservations on your behalf, including making payment arrangements with the hotel selected by you..

You acknowledge that DiscoverLuxury.com does not collect taxes for remittance to applicable taxing authorities. The tax recovery charges on prepaid hotel transactions are a recovery of the estimated transaction taxes (e.g. sales and use, occupancy, room tax, excise tax, value added tax, etc) that DiscoverLuxury.com pays to the hotel supplier in connection with your hotel reservation. The Hotel suppliers remit applicable taxes to the applicable taxing jurisdictions. DiscoverLuxury.com does not act as a co-vendor with the supplier with whom we reserve our customer's travel arrangements. Taxability and the appropriate tax rates vary greatly by location. The actual tax amounts paid to the hotel suppliers may vary from the tax recovery charge amounts, depending upon the rates, taxability, etc. in effect at the time of actual use of the hotel by our customers.

Change or Cancellation Fees

You can change or cancel your reservation online or by the listed toll-free Customer Service number. You may be subject to change and cancellation fees that our lodging suppliers impose and require us to pass on, as indicated in the rules and restrictions for reservation change and cancellation fees. Change and cancellation requirements and penalties vary by supplier and are clearly displayed in the “Detail” section of each hotel prior to finalizing a reservation.

You agree to pay any hotel the applicable cancellation or change fees that you incur. As indicated in the rules and restrictions for the hotel reservation, certain hotels may offer special non-refundable rates and as such do not permit changes or cancellations to reservations. You agree to abide by all the terms and conditions imposed with respect to your prepaid hotel reservations.

• The 110% Best Rate Guarantee applies only to Save Rate Hotel reservations made via this website. Save Rate Hotel are denoted with a special icon
• The 110% Best Rate Guarantee applies only if you find a lower rate for the same room type (which must be available for booking), at the same hotel, for the same dates, on another website selling hotel reservations. It applies to the Save Rate Hotel base room rate only and does not include any taxes, tariffs or fees.
• The 110% Best Rate Guarantee does not apply to discounted rates for senior citizens (including AARP rates), travel industry rates (e.g. IATA), corporate negotiated rates, Government/Military rates or AAA rates.
• Rates found on "opaque" or auction sites, including sites where the hotel brand and the specific hotel are not known until the booking is made, are not included or eligible for this guarantee. Also, printable coupons found on websites are also not valid source of comparison. This includes but is not limited to Priceline.com, Hotwire.com, etc.
• The 110% Best Rate Guarantee is calculated based on the comparison of the rate of the original hotel booking with the competing rate in the same currency.
• To receive your refund, fill out the 110% Best Rate Guarantee Request Form completely and submit it to us within 24 hours of making your Save Rate Hotel reservation and at least 48 hours prior to your scheduled arrival at any hotel.
• The 110% Best Rate Guarantee Request Form must be submitted by the person who made the reservation within 24 hours of making the booking.
• If the lower rate on another travel website can be verified to our satisfaction, we will match the rate shown PLUS pay you 10% of the difference in price.
• Payment of the difference in rates, cancellations and refunds are made subject to these terms and conditions and will be credited to the credit card used to guarantee the reservation, within three (3) business days.
• 110% Best rate Guarantee form

Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. Before making reservations for international travel, DiscoverLuxury.com urges customers to review travel prohibitions, warnings, announcements and advisories issued by the United States Government and other government sources and world organizations. Information on the level of risk (if any) associated with travel to certain international destinations can be found at:

www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov , www.treas.gov/ofac, www.customs.gov.

DiscoverLuxury.com, by offering hotel arrangements in any world location, does not represent or warrant that travel to such points is advisable or without risk and is not liable for any damages or losses that may be incurred as a consequence of travel to such destinations.

The information, software, products and services published on this website may include errors or inaccuracies, including pricing errors, Discover Luxury.com and the hotel affiliates and/or linked website partners through whom we provide service do not guarantee the accuracy of, and disclaim all liability for any error or other inaccuracies relating to the information and description of a hotel, air, cruise or other products described on this website. Including, without limitation, the pricing, photographs, listing of hotel amenities and general product descriptions much of which information is provided by suppliers, in addition DiscoverLuxury.com expressly reserves the right to correct any such pricing error on our website and/or on pending reservations made under an incorrect price. In such event we will offer you the opportunity to keep your pending reservation at the correct price or we will at your option cancel your reservation without  incurring any change or cancellation fees.

Hotel ratings displayed on this website are intended only as general guidelines and Discoverluxury.com and its respective suppliers do not guarantee the accuracy of the ratings or the availability of specific products and services

The hotels and other suppliers providing travel or other services displayed on this website are independent contractors and are not agents or employees of DiscoverLuxury.com.

DiscoverLuxury.com and affiliates are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death property damage or other damages or expenses resulting there-from. DiscoverLuxury.com has no liability and will make no refunds in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond their direct control. Furthermore DiscoverLuxury.com has no responsibility for any additional expense, omissions delays, re-routing or acts of any government or other authority.  

If, despite the limitation above, the DiscoverLuxury.com or their respective suppliers are found liable for any loss or damage which arises out of or in any way connected with any of the occurrences described above, then DiscoverLuxury.com or its respective suppliers liabilities will in no event exceed, in the aggregate, the greater of (a) any transaction fees assessed for your transactions on this Website, or (b) One-Hundred Dollars (US$100.00).

The limitation of liability reflects the allocation of risk between the parties. The limitations specified in this section will survive and apply even if any limited remedy specified in these terms is found to have failed of its essential purpose. The limitations of liability provided in these terms inure to the benefit of DiscoverLuxury.com and/or its respective suppliers.

You agree to defend and indemnify DiscoverLuxury.com and/or its respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

• Your breach of this Agreement or the documents referenced herein.
• Your violation of any law or the rights of a third party.
• Your use of this Website.

This Website is operated by a United States entity and this Agreement is governed by the laws of the State of Connecticut, USA. You hereby consent to the exclusive jurisdiction and venue of courts in Fairfield County Connecticut, USA, in all disputes arising out of or relating to the use of this Website.

Use of this Website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.

A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
